Eligibility
1.
I am twenty-one (21) years of age or older and I possess a valid operator’s
license issued in the United States

Use Restrictions
2.
I will never drive the Vehicle while impaired by alcohol, drugs, medication,
illness, fatigue, or injury.
3.
I will ensure the proper use of safety belts and child-safety restraints
for all occupants.
4.
I will obey all applicable motor vehicle laws, codes, and regulations.
5.
I will drive in a defensive manner, anticipating situations where
incidents are likely to occur.
6.
I will refrain, at all times, from using radar/laser detection devices.
7.
I will plan trips by selecting the safest route, depart early enough
to observe posted speed and traffic regulations, and will be mindful
of current and forecasted weather conditions.
8.
I will not permit any other person to operate the Vehicle.
9.
I will not take the Vehicle outside of the United States.
10.
I will not take the Vehicle more than 100 miles from the dealership
location.
11.
I recognize I am responsible for any traffic or parking tickets, citations
or fines incurred during my use, possession, custody or control of
the Vehicle.
12.
I understand there is no smoking in the Vehicle.
13.
I will not use the Vehicle to carry people or property for hire. I
will not use the Vehicle to transport animals.
14.
I will not tow or trailer anything with the Vehicle.
Insurance,
Accidents and Reporting
15.
I will report any accident, vehicle damage or theft immediately to
the Dealer.
16.
I currently maintain automobile liability and comprehensive property
damage insurance that complies with the minimum coverages necessary
under applicable law, and that extends to my use of the Vehicle.I
agree that I am responsible for any damage or loss of any kind to
the Vehicle while the Vehicle is in my possession, custody or control.I
am also responsible for any claims, damage or loss of any kind caused
by my failure to follow the rules set forth in this Agreement.I also
agree to defend, indemnify and hold harmless the Dealership and Mazda
USA and their respective officers, directors, shareholders, affiliates,
agents, employees and representatives from and against any claims,
demands, causes of action, expense, loss or liability of any kind
(including reasonable attorneys’ fees) arising out of my use, possession,
custody or control of the Vehicle.
17.
Customer understands that Harrelson Mazda, Inc. have obtained additional
liability insurance to protect their interests, and that such coverage
may not be available for benefit of customer. Furthermore, customer
understands that in obtaining this coverage, Harrelson Mazda, Inc.
have selected Uninsured Motorists/ Underinsured Motorists coverage
at the lowest limits allowable by law, and that such limits may be
less than those obtained by customer on their own auto policy.
Return
of Vehicle
18.
Unless otherwise approved by the Dealer, the Customer must return
the Vehicle to the Dealership in substantially the same condition
within 24 hours of the Test Drive Start Time above or be returned
by the end of business on the next business day, or the Customer’s
retention of the Vehicle will be considered a theft of the Dealership’s
property. In such cases, the Dealership shall have the right to repossess
the Vehicle at the Customer’s expense without waiver of any other
rights or remedies the Dealership may have against the Customer.

Vehicle
19.
I understand that I must leave my motor vehicle in the possession,
custody, and control of the Dealership while I have possession of
the Dealership’s Vehicle, and that the Dealership agrees to be fully
responsible for any damage or loss to my vehicle while it is in the
possession of the Dealership. I understand that my motor vehicle will
be returned to me when I return the Vehicle to the Dealership.
No
Warranty
20.
The Dealership, Harrelson Mazda, Inc., makes NO WARRANTIES, EXPRESS
OR IMPLIED OR APPARENT, REGARDING THE USE OF THE VEHICLE, NO WARRANTY
OF MERCHANTABILITY AND NO WARRANTY THAT THE VEHICLE IS FIT FOR ANY
PARTICULAR PURPOSE.

the Use of Your Personal Information
21.
Your driver’s license and insurance information will only be used
for purposes of this test drive. Harrelson Mazda, Inc. may use the
contact information you provide above to communicate with you from
time to time about our vehicle information and valuable offers. Harrelson
Mazda, Inc. may also share this information with our affiliates,
insurance, and business partners. Harrelson Mazda, Inc. will not
share your personal information with third parties for their independent
use, unless you consent.
